These Terms and Conditions (“Terms”) govern your use of the Oscar application and related services (the “Service”) provided by Oscar (“we”, “us”, or “our”).

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of the Service

Oscar provides an augmented reality tool that allows users to view information about obstacles on golf courses, including (but not limited to) distances, elevation differences, and the shape of hazards such as bunkers and bodies of water, using their mobile device’s camera.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you confirm that you meet this requirement.

4. Account Registration

Some features may require you to create an account. You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.

5. Licence to Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use, subject to these Terms.

You may not:

Copy, modify, distribute, sell, or lease any part of the Service
Reverse engineer or attempt to extract the source code
Use the Service for any unlawful purpose
Attempt to gain unauthorised access to our systems

6. Accuracy of Information

The data provided by the Service (distances, elevations, obstacle shapes, etc.) is for informational and guidance purposes only. While we aim to provide accurate information, we do not guarantee that the data is complete, accurate, or up to date at all times.

You remain solely responsible for your own decisions and actions on the golf course. The Service is not a substitute for your own judgment, course knowledge, or official course information.

7. User Responsibilities

You agree to use the Service safely and responsibly. In particular, you must not use the Service in a way that distracts you from your surroundings or creates a safety risk to yourself or others on the golf course.

8. Intellectual Property

All rights in the Service, including software, design, text, graphics, and data, are owned by or licensed to Oscar. You may not use our intellectual property without prior written permission.

9. Subscriptions and Payments

Certain features may require a paid subscription. Payment terms, pricing, and cancellation rights will be presented to you at the time of purchase. Subscriptions will renew automatically unless cancelled in accordance with the platform’s rules (Apple App Store or Google Play).

10. Limitation of Liability

To the maximum extent permitted by law, Oscar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

11. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or if we discontinue the Service.

You may stop using the Service at any time.

12. Changes to the Service and Terms

We may update the Service or these Terms from time to time. We will notify you of material changes where required. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
